Clarification on the meaning of "family member of an EEA national who has been issued with a permanent residence card"

Post by pragup1 » Mon Nov 30, 2020 12:28 am

Hi All,

The UK Naturalisation form asks for the following question:
"Are you either:
An EEA national who has been issued with a permanent residence document
A family member of an EEA national who has been issued with a permanent residence card"

Does the part highlighted in yellow mean:
a) A person who is both a family member of a EEA national AND also has a PR card, or
b) A person who may not necessarily have a permanent residence card but their EEA family member has one

I am a non-EEA family member who has Settled Status but not PR. My EEA/British dual national family member had acquired PR prior to her naturalisation. I interpreted the above question per b) and hence answered Yes to the above question in the application form. Was my response correct?

If not, How can i correct the above mistake.

Many thanks

You don't need both PR and Settled Status - clearly you don't have a PR document so check NO here and then check ILR (Settled Status).

Agreed but unfortunately that ship has already sailed as I've already submitted my application. I still have not submitted my documents on the ukvcas website. Is it worth clarifying the above point in a cover letter?

Put the facts into a letter and upload with your application. Include your UKSS reference number. This is not an issue happens frequently.

It means (a), as only non-EEA family members of EEA citizens get a biometric Permanent Residence Card. EEA citizens get (or used to get) a non-biometric Document Certifying Permanent Residence. They are completely different types of documents and would be referenced differently.
