Unmarried partners work permit for Romanian

Post by the_mady » Fri Sep 19, 2008 12:22 am

Hi! I wonder if anyone can help me answer some questions regarding my rights to work in the UK as a Romanian who's engaged to a British citizen.
My fiance and I have been living together for more than 2 years now - in Spain - but now we moved to the UK because he has to go back to uni. My questions are:
1. Does this unmarried partner visa apply to work permits as well? (I don't really need a visa to enter the country, I'm already in)
2. How many pieces of evidence are required to sustain the application? I heard at least 20 each (ideally for each month of the last 2 years)...?
3. What's the average time of processing the applications?
If you know anything from experience or if you can point me to other websites where I can read more about it, it'd be most appreciated.
Thanks.

Under European Law, as a Romanian national, you do not need permission to enter or remain to live in the United Kingdom. You may apply to work in the UK.

Alternatively, if you qualify as an unmarried partner, then you may apply for prior entry clearance. Unfortunately, I don't think that you may switch to FLR(M) (295F), as you do not have leave to enter or remain, and would not satisfy 295D(i). Interestingly, spouses should be permitted to switch (16. EEA National Spouses of British Citizens and Settled Persons). However, see also Refusal To Grant Leave To Remain.

So, if I understood correctly I have to get out of the UK and apply for the entry clearance from abroad. Then, once we've got that, I can come and live together with my fiance? It's a bit contradictory as I've been granted a right but then I can't enjoy it fully...
However, I'll try this way as well. At the moment I'm working on a project outside the UK, and I have some time until I finish, so we can try this alternative.
Any ideas on how long it would take and how many documents we need to gather?
Thank you.

If you're currently working on a project outside of the UK and intend to apply for an Unmarried Partners Visa, be aware that there is a limit to how much time you can spend apart. I believe the maximum in one
gap is 3 months, but get confimation on this.

That's not a problem. I go "home" every 2 weeks, and the project won't last more than 3 months anyway...
No idea about how many documents I need to gather? My partner is a bit stressed cause we only have about 10 each, and in case we need 20, that wouldnt be enough...

For in-country marriage and partner based applications such as SET(M), and FLR(M) you need 6 documents from 3 different sources.

However if you're applying from outside and on the basis of your longstanding relationship I would go in excess of the above just to be safe. 10 each should suffice in any case as the old requirement was a total of 20, not 20 each.
Oh, the drama...!
