h.o time scale for eea pr application.

hi
does anyone have an idea on the current time scale of the home office in granting eea pr. as my brother has had his with them for eleven mths . they only asked for more info 5mths ago and we havent heard from them since.

any idea?

I guess the EEA casework section is in a bit of the mess at the moment. The application should be handled within 6 months, so he certainly has the right to complain. However, I would not be surprised if the caseworkers focus on new applications for residence cards, because those are more urgently needed.

The good news is that your brother automatically gets PR once he satisfies the requirement (5 years legal residence under European law). The application is just giving you the confirmation of an existing right. For example, he could apply for naturalisation without waiting for the outcome of this application.

hamadauk123, it a bit complicated they wanted proof the wife was exercising treaty even though it was explained to them that they were separated ,thy also wanted to know the wife current address and current payslips from the non eea.

well i would ve taught so but a guy who he met at his lawyers office had the same problen ,he is still with his wife and she has got the mp to write them and they replied is under consideration.
my thing is either they grant it or refuse it. wats the use of keeping it for almost a year without telling the applicant wats happening .i think they are incompetent.

My application:

PR after divorcing EEA husband (right to retain residency) using EEA4 form. Sent Dec 2007. More evidence needed July 2008 and Aug 2008 - evidence submitted. No reply to this day, nearly a year after initial application.
