Help needed

Hi all.

I made an application for my wife who is pregnant. She has been here for 2.5 years, and I was supposed to make an application for extention. As we don't qualify under the 5 year route I thought we'll do it under the 10 year route, so I applied what I believe to be Set M.

I only found out when I received a call from the NHS that she was being falgged. We are avoiding going to the hospital as we were told the IHS payment hasn't been made and we will have to pay £5500.

Please advice what we can do to resolve the issue. I can't afford to pay the £5500 or apply for a new application.
Also, will she become a overstayer?

You have incorrectly applied for ILR using SET(M) rather than extension under FLR(M) or FLR(FP). Note that ILR application does not require any IHS payment. If you do nothing, the UKVI will notice that she does not qualify for ILR and offers to process her application under the 10 year route, asking you to pay the required IHS.

However, if you need any proof of IHS payment sooner, then you should apply for a new application under FLR(FP) (if you do not have the finances required under 5 year route) and pay the IHS fees as part of that application. This will vary the previous incorrect ILR application to the correct extension one. You will get a refund for the incorrect SET(M) application later

Thank you. If I make a new application will I get a refund? Also, will my wife be considered to have overstayed?
