Hi,

My brother is a European National, received his EESS settlement(permanent residence one) last year. He got married an Indian citizen and has a child, who is 3 years old now.

His wife and child came to the UK in October 2019. But the time they arrived in the UK, they both lived separately because my brother didn't want to live with them. However, he helped them to get the visa. The wife got Pre-settled status and the child got settlement status.

The issue started when my sister in law tried to apply for benefits and they couldn't because my brother moved back to the European country straight after applying for the visa. The time my sister in law got the visa, my brother was not in the UK. So in January 2020 my sister in law and the child went back to India because she was not ready to find a job.

Now my question is: my sister in law wanted to come to the UK with her pre-settled status and her child's settlement status. Will she be allowed to enter the UK when the main sponsor is not in the UK?

What is her option to come to the UK? I'm just worried about the child so I would like to support her the maximum I can.

Please note: my sister in law concerned about her visa, not her life and my brother accused her that she married him because of the visa. so please no judgment here. I only trying to find a solution so my brother's child can have a better life, as I don't trust both sides.

Can someone please advise me on this matter how to proceed?

It depend if your brother depart uk without narrating the visa issues to the home office, if he does there a chances of curtailment of the pre settle visa,
Simply ask sister in law to check her status online, if it's still showing on system definitely she will be allowed to uk
