Fined 15 years ago and never disclosed

Post by MD2016 » Sun Jan 17, 2021 8:08 pm

Hi all - I’m doing my ILR application, I intend to submit in a couple weeks.

I realise, through stupidity and a misunderstanding of the law, that I never disclosed on previous applications that I got fined whilst at uni for ‘loud and unnecessary noise’ (ie, my housemates and I had a party and I was the one issued the ticket). This was 15 years ago and I do not have a criminal record. I genuinely didn’t realise that a ‘fine’ is considered a conviction and was told back in the States that what I received was like a speeding ticket and not to worry about it anymore once the fine was paid. On my previous visa applications I always selected ‘no’ in the section about criminal history.

So, I’m inclined to include it now for full disclosure but I’m worried that I’ll be refused as they believe I’ve been deceptive. The fine itself isn’t, or wouldn’t have been; grounds to refuse a visa application here, but again, I’m more worried they’ll refuse because I failed to disclose on other applications.

So; what do you think? Am I in for a world of hurt or do you think I’ll be ok? I have two little kids here, one in school, and the thought of being refused and having to move country is really stressing me out. Not to mention my husband doesn’t have a residency permit for my country.

Thanks!

No need to declare this. You are overthinking.

Ha, ok. I think I probably do need to declare as I had to go to court to receive the fine. But it probably won’t impact my application since it was so minor and so long ago!
