Hi all,

I'm currently pregnant and freaking out a bit about the baby's immigration status. According to the EUSS, you three months to apply for the settlement scheme for your newborn or adopted child. You need the child's ID to apply (passport/ID card).

My main issue is how on earth I'm going to get an ID for the baby in that time frame.

Once the baby is born, I need to:
- register him in the UK to get a birth certificate (this is currently by appointment only).
- translate his certificate (takes 7 days aprox?)
- legalise his certificate with an apostille (currently 10 working days).
- complete his passport application and have my husband's signature notarised as he's not from the EU.
- legalise the notary public document with the apostille ((currently 10 working days).
- send all the documents to the consulate and pray to somebody that it doesn't take long (currently, they told me it takes around 6-8 weeks).

If I don't apply on time, he will be breaking immigration law. I currently have pre-settle status, so he won't be automatically British.

Does anyone know if the home office might accept his birth certificate for registration or other types of identification?

"If your child is born or adopted in the UK before 1 April 2021, you must make an application for them by 30 June 2021.
If your child is born or adopted in the UK on or after 1 April 2021, you must apply within 3 months of the date they were born or adopted".

The child will require an identity document for registration.

Same here - baby is due before 1/04, so I’ll probably have 3.5 months instead of 3. Not sure if this is feasible

As the baby is naturally born, no such restrictions can be placed on him or her.

Once you acquire the passport apply under the scheme for the child.

Hi again,

I received some informal advice from a solicitor.
I will need to contact the EUSS resolution centre and ask for altternatice evidence of ID to be accepted until I get the baby's passport. This is done through a papaer form. Once the ID arrives, I can update it.

Also, the home office has recently published (19 January 2021) a case worker guidance for EUSS applications. There is secction about alternative ID evidence.

I hope it's not to complicated to go this route.
