10 year settlement (ICT + Tire 2 Gen Dependent)

Hi,

My name is suresh Good Morning every one. I am new to Immigration Board channel.

I came to Uk Tire 2 ICT through Company for 5 years and went back to India. And came back to UK on Tire 2 General Dependent with a gap of less than 1 month visa dates. I want to know am I eligible for applying ILR through 10 years settlement? Can some one please help.
Bellow are the dates

If you are here with 5 years under PBS dependent that is a simpler and more successful way rather than 10 year route.

Is there any particular reason why you are not going down the the dependent route?

I will complete my 10 years by 26th July 2021 and my 5 year Dependent Visa By 25th August 2021. Currently we have Issue with my wife Employer who sponsored Tire 2 General VISA they are doing some redundancies. So I am exploring all the options available. Is there any specifics why 10 year route is more difficult?

What is her immigration status for now. Is she on Tier 2 visa for now or has she already had ILR? What are her dates?

For you to secure ILR via the PBS dep route, your wife (main applicant) has to get the ILR first (via the PBS route). So if things are bad with her employer it can possibly jeopardise both your visas.

If you qualify for SET(LR) earlier and meet the requirements, you may consider that to be on the safer side.

If you had leave before departing the UK and came back within six months, etc., then you may be okay.

In between the visa I have 1 month gap.

I am meeting the requirement of

You can leave the UK during the continuous residence for up to:
180 days at a time
540 days in total

Also note, your wife will still have to settle via the Tier 2 G route. If things go wrong with her employer as you said, she may have to change to your dependent visa -FLRM (given you get ILR via LR) but that would reset her time for ILR on the 5 year route but not the 10 year LR route.

*hypothetical situation for the worst case scenario.

If she qualifies for SET(LR) by the first week of Sep, she has an option to settle via the LR route given she meets all other requirements. No need to switch to your dependent in this case. Note, if she switches to LR, you will not be able to settle via PBS route anyways. But you are considering LR route also for yourself so you will be okay.
