leave to remain

Post by latinointheuk » Sat Feb 13, 2021 9:56 pm

hello friends,

i am going to apply an extension for my partner, she was granted the 10 year partner route under paragraph D-LTRP.1.2.OF Appendix FM. we have a 6 year old son who was born here and is a british citizen.
what are my options?
1..carry on applying for the 10 year route visa to get the ILR permanent
2..can a switch to ILR as we have a son who is born here
how long before the visa expires can i apply? expires on the 18.04.21

i myself have ILR permanent
thank you very much

You are better of switching to 5 years route so that she can get ILR quicker within 5 years which means clock will reset if application was successful under 5 years route.

Staying on 10 years route means she will continue to renew at least 3 x.2.5 to complete 10 years in the UK, you can qualify for ILR under long residence route.
My opinions should not be constituted as an immigration or legal advice.
