Futlough effect on ILR

Post by opteml1 » Fri Jan 29, 2021 12:26 pm

Hello Experts,
I am on Tier 2 General Leave to Remain (employer Sponsored) visa. I plan to go for ILR next Year December. (Sorry to ask this very early but would like to know, since for ILR it counts the salary for past 5 years ).
But unfortunately I was placed on furlough and was on 80% salary for 3 months.

1. Will this be having a negative effect on the ILR application when I apply for it? Can any one clarify it please?
2. Is the salary limit for Tier 2 General Leave to Remain (employer Sponsored) applicable for furloughed people.?
3. Also is the salary limit before tax or after tax. ?

Regards

It should have no effect as Home Office has come up with the below relaxation

https://www.gov.uk/guidance/coronavirus ... -residents

Changes to the minimum income and adequate maintenance requirement
If you’ve experienced a loss of income due to coronavirus up to 31 May 2021, we will consider employment income for the period immediately before the loss of income, provided the minimum income requirement was met for at least 6 months immediately before the date the income was lost.

If your salary has reduced because you’re furloughed we will take account of your income as though you’re earning 100% of your salary.
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Hello,
Thank you for your response. I was completely at lost because of furlough and this mail was kind of relief for me.
The last sentence, I could not get that:
"If your salary has reduced because you’re furloughed we will take account of your income as though you’re earning 100% of your salary."
Does that mean for the furlough period the 80% of the salary(which I am getting during my furlough period) is my 100% salary .

Regards
Sane
