Switch from Tier 4 Student Visa to BNO Visa

Hi all,

I am now on my Tier 4 student visa which will expire at the end of next month and have applied for a BNO visa inside the UK awaiting approval. As I have had a full-time job in the UK (on my student visa) and it's possible that the BNO visa is approved after my student visa expired, I wish to confirm that after my student visa expired and before the BNO visa is approved:

1. Am I allowed to stay in the UK?

2. Am I allowed to keep working in the UK (on the same job)?

3. Am I allowed to leave the UK before the BNO visa is approved and return after it is approved?

The answers below are based on the statement above, that you filed the BNO visa application before your T4 application expired.

1. Am I allowed to stay in the UK?

Yes.

2. Am I allowed to keep working in the UK (on the same job)?

The terms and conditions and requirements of the Tier 4 visa continue to apply until the BNO visa is approved and issued. So, if the T4 visa allowed that work, yes.

3. Am I allowed to leave the UK before the BNO visa is approved and return after it is approved?

If you leave the UK while the application is in progress/before the grant of the BNO visa, the application is automatically treated as withdrawn. Best not to travel abroad until you get the visa in hand.
