Is BRP date used for calculating ILR quaifying period.

Post by aviator66 » Wed Mar 10, 2021 10:06 pm

Hello folks,

I need inputs for my query....
I came to Uk with tier 2 shortage occupation visa on 30/Jun/2016 and my visa expires on 27/May/2021. However, my BRP date of issue is 24/June/2016. My entry clearance on Passport starts from 30/jun/2016 only. Will I be able to apply ILR using the 28 day rule on 26/may/2021 with my BRP date of issue to calculate my qualifying period. My company lawyers told me that UKVI will consider details on passport only and they are not sure whether UKVI will take BRP dates into qualifying period. If that is true, what are my options for applying ILR. Please note that my leave of absence for the first year is only less than 2 months.
Thanks in advance for your valuable suggestions.

Regards,

You need to take the earliest date. Visa approval date in most cases is the same as the date on your visa approval letter, sticker and BRP issue date. However, for administrative reasons, the date of your document could be a later date as an immigration document cannot be backdated. So if your visa was approved last week but the sticker/BRP is produced or printed today, it will have the today's date (that is simply the issue date and not necessarily the approval date). So as long as you use the earliest date which is your BRP, you will be perfectly safe. From the immigration rules perspective, your qualifying period starts from the date of visa approval which may or may not be the same as your immigration document issue date.

Thank you

A visa approval letter you may have received. In your case, simply use the date of the BRP and move on with the application

If your degree is from a UK university, you only need your degree certificate.

You are overthinking. As Zimba said use the BRP date. However, if you really want to check, you may use:
