ILR advice please

Hi everyone,
Thanks in advance to anyone who can share your experince if it was similar to this.
1.ILR application on basis Long residency(10 years=5.5 student+almost 5 on WP with one employer).
Personal visit to PEO.Primium paid.
Offficer check the dates of visa issued.All student visa OK.
The entry clearence for WP was issued 3 days after expiry of previuos student visa.Not my fault,agent presumably applied for WP and after approval sent (I do not for sure)to HO,which recieved 3 days after my student visa expired.
ILR refused due to broken period 10 YEARS continue period.I am going to check with agent what had happened at that time,but can situation saved if WP was approved after visa expired and agent when received conformation sent passport for entry cleareance on time.
2.Reason I applied on long term basis bacause I had opportunity to change employer without restriction to work with different company.I told this to my current employer and I would probably will be sacked.I have only couple weeks left to be eligible to apply on WP basis.How to remedy this situation if employer will report me as I terminate work for them.

I appreciate your advice lads.

bobb,

The thing with long residence applications, you need to get your SAR file way before you make the application to see whether you have any gaps. So l think you need to get that file, but that may leave you as an overstayer as it can take up 2 months to get the info. So l would say reapply for the new work permit with the other company, request your SAR file and then take it up with the agent you used to see why there was a gap and if you can reapply with new information to explain the gap you may be lucky to get your 10 year application approved at the discretion of the case worker.

bobb, you need to ask the agent if he retained proof of postage or any other records/bits of paper he may have to show when your visa was actually posted. Or did the agent do a same-day application at the PEO?
