Spouse visa guidance

Post by bnsrinivas » Tue Mar 09, 2021 8:35 pm

Hi All,
I am on ILR. I am planning to apply for a visa for my wife (spouse dependent visa) from India. She was in the UK on a dependent visa till Feb 2020. She has been to India for vacation, with the plan to return in April 2020. Due to the pandemic, she could not travel back. Now her visa is expired. I am planning to apply for the visa again for her. I understand from this forum that, I need to apply again for an entry visa. I have a few queries, I request to please respond.

[1] I am a director of a limited company. The financial year for my company is from 1st April to 31st March. I am planning to apply for a visa before 31st March 2021 due to my income is good in the previous financial year (1st April 2019 to 31st March 2020). As per my understanding, I can show income evidence for the financial year 2019 to 2020, if I submit my application before 31st March 2021. Please let me know if I am missing something here.

[2] To prove our relationship, I submitted a marriage certificate, marriage invitation, marriage photos and whatsapp calling and chatting screenshots on my previous application. Since our relationship was accepted earlier; do I need to submit all the above again?

[3] I am planning to use bank statements downloaded from online (pdf format). Do I need to submit original statements?

[4] For earlier application, I have submitted notary certified copies like my passport, ILR etc. Since I can upload now scanned copies, do I still need to have notary certified copies?

Thank you very much in advance for your help.

You my wish to consider the following:

On 11 January 2021, the Home Office published a Covid Visa Concession Scheme. It is designed to help people who had permission to live in the UK but whose permission expired while they were stuck abroad due to coronavirus travel restrictions, leaving them unable to return. Provided they meet the eligibility criteria in the guidance, such people will be granted entry clearance valid for three months to allow them to travel back to the UK and apply properly to extend their stay. But the scheme is aimed at people who left the UK before 17 March 2020 (the date the Foreign Office changed its travel advice, apparently).

Those who left the UK after 17 March 2020 will only be considered for this concession in “exceptional circumstances”. These include “serious illness or death of a close relative overseas” and “travel for the purpose of receiving medical treatment”.

Just for information, the end date for this is 31st March 2021

Extract from Gov.uk
You need to reply to the confirmation email within 48 hours of receiving it. If you do not reply to the confirmation email within 48 hours you must complete the form again for us to consider your request. You do not need to contact the Coronavirus Immigration Helpline or mailbox again once you have replied to the confirmation email.

Once you’ve replied you’ll receive a response. We will aim to respond to you within 10 working days.

This concession will be available until 31 March 2021.

PLS HELP - Covid Visa Concession Scheme

Post by bnsrinivas » Thu Mar 25, 2021 5:52 pm

Hi All,

My wife went to India last year in Feb 2020 to meet the family with the intention to come back in April 2020. Due to the pandemic situation, she could not come back. Her visa expired in Feb 2021. But we have applied for the "Covid Visa Concession Scheme" to come back to the UK. Today, we got a confirmation email that she can plan for travel. I confused with the guidelines provided.

https://www.gov.uk/government/publicati ... accessible

It will be the responsibility of the person concerned to check the exit requirements of the country they are currently in, as not all authorities will permit exit without a valid visa being issued by the destination country. In these circumstances, or if the customer requests a visa, the person can apply for entry clearance in the relevant route. Where there is no relevant overseas route, you should tell them to apply for a LOTR consideration using the following:

[1] I guess, the "Covid Visa Concession Scheme" inform UK border security and Stupid only. What is the exit criteria for India? Are we permitted to leave the country (India) without a visa?

[2] How to apply for LOTR ?

Please reply to me, if anyone used this concession scheme. I am desperately looking for help.

Thanks in advance for your advice.

Unfortunately not a lot of people are in the same position as you and the guidance posted on the GOV website is very vague.

You will expect to have an entry clearance visa to get into the UK and you are current outside of the UK which maes things bit difficult in terms of getting an entry clearance visa to travel to the UK so you will need to continue to wait for UKVI reply.

Thank you very much for reply. It is difficult to understand the rules from the portal.

I am clear from the web site description and follow up emails from UKVI, that UKVI will inform to Stupid and UK Boarder Security about the travel with expired visa. So I am not concerned about Stupid and UK Boarder Security. I am concern about Indian Authorities.

Is there any rule for Indian Authorities to have a valid visa to destination country before leave India?

Thank you

You will have to make an enquiry on your own by contacting the India authorities.
