Family or Settled

Post by ob1ta » Fri Mar 26, 2021 1:05 pm

Hi,

My wife is applying to extend her LTR under the five year partner route.

She is in the uk based on 30 months of limited leave to remain under D-LTRP1.1.

Now she is doing the application form to extend. There is a question that I find unclear what to put:

What type of visa, leave to enter or remain or other permission do you have to be in the UK?

Should she put 'family', or 'settlement'?

Somebody we know said they had their visa refused for putting family, so we are thinking of putting 'settlement'.

Thanks in advance.

Family route is the correct option.

Thank you for your answer.

In the context of this question, what do they mean by 'settlement'?

I am a bit concerned because this person put settlement in her video guide: youtube weblink removed by moderator

Settlement is used in relation to someone applying for Indefinite leave to remain in the UK although sometimes in the past it is also used for those people who are applying for spouse visa from abroad but by looking at the official guidance the word "Family" is used in conjunction with Article 8.

See heading of this link below

https://www.gov.uk/uk-family-visa

Upon looking many other forums, it seems to me that either have been selected and application has been successful on those occasion but you cannot say it is a settlement visa except a family visa by definition of settlement under immigration rules

“Settlement” means indefinite leave to enter or remain.
