I am confused about my lawful residence. I am an eea national family member ( myself non eea). I got settled status under the eea settlement scheme in 7/2/2020 and applied for naturalisation after 12 month on 9/2/2021. I am reading this forum and try to figure out lawful residence for non eea family member of eea national. If you can help me it would be highly appreciated and thanks in advance.
My immigration history:
First came February 2009 student visa. Then got post study visa until December 2012. Then residence card under self sufficient for 5 years until april 2018. Until this period every thing is continous residence and no issues. We both have CSI until we got the settled status from December 2012. But in 2018 we both applied for PR residence and it was denied because my wife had gap. We applied seeking discretion but it was refused. We made an appeal but later withdrawn and apply for residence card renewal and got it again until January 2024. All the application was in time. Appeal on time and withdraw it on the home office suggestion because otherwise I couldn’t apply for renewal. After getting my RC renal my wife got her settled status and i also got immediately after her.
Now my question is, because my PR application got refused for the break of continuous residence of my wife, does it make my residence unlawful for that period even we always have CSI? I have always been in the uk and i was employed. I used to visit my wife during that time. I even visited my country and had no issues returning uk.
Second question: i am aware of the CSI requirements for naturalisation application but when i filled my application i got the documents list where it didn’t ask me for the CSI. Now im confused if i made mistakes in the application? I have answered question with honesty and best of my ability. But I wonder why it wouldn’t ask me for CSI. Will it have a negative impact on my application or home office will ask more documents or clarification?
