Housing & Council tax benefit

Post by kiroren » Sun Oct 05, 2008 3:16 pm

I am british, my husband is in the u.k on a 2 year spouse visa. He is self employed, having only recently arrived in the u.k, business is slow and sparse.
I have just put in a claim for housing and council tax benifit, for myself, i did not include my husbands name and details but did include his income so it would be deducted, i also noted on the form that it was a claim for myself as he was prohibited from claiming. They have now written to me asking for his name and NI number..

I believe that this claim should only be in my name or it could cause problems? is this correct? please advise on how i should deal with the council?
Thanks

kiroren, are there any children in the household? Or just the two of you?

Claims for housing and council tax benefit are made by just one person, but you have done just the right thing, mentioning his income.

Has your husband registered his self-employment with HMRC? Has he now got a NI number? OR at least applied for one?

Hi John, thanks for your reply, yes we have 1 15 month old and i am 8 months pregnant :-)
My husband has registered self employed and has recently had his interview for NI, they told us to expect the number to arrive in 3-6 weeks.

So it is ok for me to supply the council with his details? it wont cause a problem when the time comes to apply for ILR?
Thanks

kiroren, sorry, I didn't spot your reply previously (and have just deleted the duplicates).

A few benefits in play here. Firstly you are no doubt already claiming Child Benefit .... no problem! Also Tax Credits? Also not a problem, but can you confirm that the claim is in joint names of you and your husband? It would be wrong for you to be the sole claimant of Tax Credits.

Housing Benefit and Council Tax Benefit? Yes they will need his NI number, hopefully now received. And no problem you claiming those benefits if there is an entitlement.
