Dear friends,

Hello to all,
This is my first time I am posting a request on this forum.
Please help me to resolve my extension problem,

I am in the UK since july 2007 and now
I have to apply for HSMP extension before 15th of feb 2009.
I received approval letter on 6th of Jul 2006.
Then my entry clearance at embassy was refused till 15th Feb 2007

There afftar i decided not to move to UK till 15th of Jul 2007.
So I spent 5 months outside UK.

Now I am facing difficulty with Tier 1 rules. Only because I don’t have any form of evidence to prove my English language ability. Even my Masters degree in engineering which is testified by NARIC brought me 35 score but 0 score in English.

I am reluctant to apply for IELTS.

Currently I am scoring in all of the sub categories but not English.

My question is
Can I apply under the rule of extensions as by judicial review made?
And get exemption for English.

The first 2 pages relates to me.
I am confused,(':shock:') as if the above rule applies to me or not?

Also I need 3years and 5 months till indefinite leave.
According to clause 9a and 9b of the above link, will I get 3y extension or more?

From the guidance notes, yes, you qualify for extension under the old rules:

Following the High Court Judgment of 8 April
2008, migrants who obtained leave to enter or
remain based on a letter of approval issued
under the HSMP criteria in place before the
programme was suspended on 7 November
2006
should be considered against the
extension criteria in place when they joined the
programme.

About the visa validity, I'm not sure. I've only seen people get 3 years more than their original visa. So in your case Feb. 2012.
