citizenship time clause

Post by rajashakergoudranga » Wed Apr 28, 2021 4:30 pm

Hi Team,

My son born on Jan30 2019 in UK, at the time both parents have Tier 2 visa. We are eligible to apply ILR in 2022 June. Our son went to India to spend time with grandparents. We dropped him in India on Dec 10 2020. We are planning to bring him back march 2022.Once we got ILR, can we apply direct citizenship via naturalization to our son?
Does below clause applies to the child citizenship application?
90 days outside the UK in the 12 months prior to submitting their application

Thanks,
Raj

No residence requirements in your son’s case. Yes he can be registered as British after at least one parent has ILR. Children are registered, not naturalised.

Does your son have valid visa to come back to UK?

You can register him as British even if he stays abroad after at least one parent has ILR. But it is best if he can come back to UK (given he has valid visa) and you register him inside UK. It will be much simpler and quicker process.

He had valid visa until may 2023. Just want to check registering children as citizen also cost 1500 pounds right?
