Eea permanent residence used for naturalisation

Post by minion » Sat May 01, 2021 11:19 pm

Hi everyone.
I hope some one could help me. My wife applied for naturalisation with EEA permanent residence card.
My questions are
1. Due to new rules with Brexit can she stay in uk while waiting for application (we didn't applied for settled status, our mistake)
2. If she can't , can we cancel application and get full refund(no biometric have been submitted yet)
3. Can we apply for settled status without losing applicants for naturalisation.
Option 3 would be the best outcome, but if can't go with option 3 then 2 (don't want to loos fee for naturalisation)
Thank you

1. Due to new rules with Brexit can she stay in uk while waiting for application (we didn't applied for settled status, our mistake)Naturalisation application in progress doesn't give any residency rights on its own - apply for settled status.
2. If she can't , can we cancel application and get full refund(no biometric have been submitted yet) no need.
3. Can we apply for settled status without losing applicants for naturalisation. Yes - note that naturalisation is not an immigration application.
Option 3 would be the best outcome, but if can't go with option 3 then 2 (don't want to loos fee for naturalisation)

Thank you for the reply.
Do we need to wait to submit documents for naturalisation first or we can apply for settled status before that?
Is there any reference in immigration law to support this?
Thank you in advance

Settled Status is part of immigration regulations - and the deadline for applying is 30 June 2021 - if you don't you don't have a status as the EU Permanent Residence card expires then. It's the law - the government has publicised this on their websites.
Naturalisation is nationality law - not immigration. You are using the PR card which is valid for that purpose.
