ILR received through Accelerated route to Naturalisation

Post by meenu2104 » Mon May 03, 2021 6:14 pm

Hi,

I received my ILR through Accelerated route in Jan 2020, I need someone's assistance to know when I can apply for Naturalisation.

I was in ICT tier 2 Visa from May 2011 to 2016
I got my Tier 1 Entrepreneur visa in 2016 for 3 years till 2019 subject to 2 years renewal
As I fulfilled the conditions on my completion of 3rd year I got my ILR in Jan 2020 under Accelerated route.

Normally after receiving ILR you are eligible to apply for Naturalisation after 1 year but here I heard I have to wait for 2 years from ILR received date to complete 5 years.

Basis above am I eligible to apply for Naturalisation in Jan 2022 minus 28days.

I would be pleased if someone can assist me on the same.

Thanks and Regards

As far I know, you qualify for Naturalisation since Jan 2021: as long you have held ILR for over 1 year and fulfil the 5 year residence requirements (& all other AN requirements) in UK between 2016-2021, you are eligible to apply as per Section 6(1) BNA 1981 (in your case assuming you are not married to a BC).

Naturalisation is not an immigration application. It comes under the Nationality laws.

The requirements for naturalisation are, among others, that the applicant have spent at least five years in the UK and that the applicant has held ILR at least a year. The types of visas that the person would have held in those five years is immaterial.

As @CULLINAN has mentioned above, you are already eligible to apply for naturalisation.
