Advice please....

Post by edrelle » Thu Oct 09, 2008 11:09 pm

I am on 5 years WP visa and eligible to apply for ILR this Nov. I have two question pls!

If I get ILR

1. My daughter born here in UK in 2005 but I brought her in my country 5 months after she was born (she is 3 yrs old now) I am going to get her as soon as I get my ILR..what kind of visa should I apply for her I mean dependant visa or some said I can apply a british passport for her already as she is born here?

2. My husband just been here for 1 yr and 7 months (dependant visa) is he eligible to apply for naturalization after a year of getting a ILR? Some said he needs to be here for 5 years?

thank you in advance

1. After you and husband have ILR, she may apply for a child settlement visa.

2. Currently, he will require five years (or three years, if you become British first).

As child is U.K. born then as soon as one parent has ILR, then an application for British citizenship can be made under section 1(3) of the Act.

Child does not need to have ILR or even be U.K. resident. Application for registration should be made to the British diplomatic mission in the country concerned, which will be forwarded to the Home Office for decision.

Once the child is registered British, child can apply for a British passport.

This can be done as an alternative to, or in conjunction with, a settlement visa application for child.
