Wife's and son's British passports at the Home Office

My solicitor advised us to send original documents to UKBIA when making my application under HR (Article 8 ) in Feb 2006 (haven't heard anything yet). My wife's and son's original British passports were included.

I am now in the process of leaving the UK to apply for a re-entry clearance. My plan is to take my son with me but his passport is with UKBIA. We initially asked them to return the passports 4 months ago and later our MP got involved. UKBIA wrote a letter to our MP 5 weeks ago. They said the file has been requested into a case working team action and once the file has been received the passports will be returned. Now this is the part I don't understand, a while ago though I cannot find it now, I read on their website they return passports in 28 days once a request has been made. Without taking into account our initial request, the passports has not been returned even after 10 weeks of our MP's intervention. We have just contacted our MP and he said to give them a week or two and he will write a letter to UKBIA. MP's second letter looks to me we are running into a vicious circle. What can we do?
