Snooky that was the same refusal letter I received from them back in December. Then in February they sent me a COA to allow me to work and told me they are making decisions on my case I was like what the hell are they trying to do ? You have already refused my application now you are sending me a COA
And that was after I lodged my appeal

Well the consent order does not seem to apply to derivative residence card application.

It applies to the settlement scheme.

The refusal is the copy and paste standard 4 pages.

Well said Obie but HO knows this case will prevail when it goes to court.

The consent order reference and cited the reg 16 and the judge was clear.

HO whether euss or not, the most important issue is still assessing eea reg 16 within the withdrawal agreement.

HO, do the right thing?. No, because they are allergic to it. Looks like they are also allergic to being straight forward.

After a thorough check up and proper diagnosis, on June 9, 2021, HO has already been given a 'prescription'. How on earth can you help an adult who has refused to take medication? Unfortunately, there is no epipen for this one.

Even if HO sees the 'handwriting on the wall', HO will send immigration enforcement to arrest that hand, take it's name and DOB, thumb print it, pending removal.

As for the writing on the wall, HO will send graffiti removal.

I feel the same as you, Have been in to this for 5years now, have previously got a leave as a family member of an EEA citizen for 5 years. They refused my permanent residence card and since 2016 have been without any leave and fighting the HO with all have got.
It just break my heart to read your post but sis don’t be sad, we need to keep fighting. I know, it feels like the waiting will never end but we can’t let HO break us.
We are going to win this together my sister Lulu.

I think you can work without any problem. As your appeal has been allowed you should just tell your employer to do employment check, it’s online. Your employer might know it. So I don’t think you should worry about your job.

As that will determine when you will be getting a card for EEA i doubt they will be issuing new card as they expiry that comes on them is past anyways. Regardless of which appeal you won your Zambrano rights still continues and that should guarantee you a work right as Miss Suz mentioned. HO would usually have 28days to put in an application to appeal at the upper tribunal. You might want to ring the court 28days after the promulgation was given to see if any application has been brought in, if not then you can follow through with Snooky's advice. I didn't have to chase them when I won my EEA appeal they just sent my card straight way and a letter few days afterwards.

My EUSS appeal was allowed and I gave called the court 3 times to check it the HO appealed but they didn’t, last day for them to appeal was yesterday. I checked my application online but still showing the same as Your application as been refused. I’m worried that if a right to work check is carried out it may come negative. How long did it take for your card to arrive after determination was promulgated please
