I know separation divorce for an immigrant needs extra thinking specially if you have kids.
I really don't know what to do and where to begin.

- From INIS’s perspective, cheating itself does not violate or contradict any immigration related matter. This means, as long as you are still living at the same address and married, INIS doesn’t care that your husband is cheating.
- You could initiate a separation process. If that’s what you intend to do, you will need to inform INIS as soon as it happens.
- Try to gather some evidences of your husband cheating on you. This could be very important for both divorce proceedings and your immigration status.
- Now the immigration bit: subject to you meeting all requirements in the past 5 years as an EU Treaty beneficiary, you are considered a permanent resident from the 5 year mark. This status is *independent*. You do not need to be in a marriage with anyone with this status. This means, having a divorce / separation now should not affect your residence rights at all.
- However, the actual practice is that INIS will not recognise you as an independent permanent resident until your EU3 is fully approved. The application may be further delayed if you tell them you have been separated now.
- You do not need to find a solicitor now, as your immigration status should *in theory* already be an independent permanent resident. However, if INIS gives you any hard time without legal basis, you can then find a solicitor and sue INIS.
- You may want to find a marriage solicitor in case you want to go for separation / divorce.

Stamp number is just a stamp number. It doesn’t mean anything other than telling the officials what permissions and entitlements the person has.

I never received postal acknowledgement by post n only email confirmation. What valid permission? Cant even travel. Doesn't make any sense at all.

Usually they send a letter by post while you are waiting on your decision we can get a temporary extension.
Yes email EU TREATY directly for Stamp 4 extension. But is it not like this that when you apply through a solicitor than they become your representative and they should be requesting temporary extension? they are getting paid for it.

Also, i applied on the basis of being separated with my spouse not divorced.
Would they issue a letter so i can apply for the stamp myself or would their still be a requirement of myself and the eu citizen to register at the garda station to obtain an IRP card? I cant do this since we are saperated.
Please advice
