Partner Visa Granted on 10 Year Route???

Post by 777GE90 » Mon Aug 16, 2021 9:23 pm

Hello, I recently applied for my partners visa to come and join me in the UK from abroad, I understand that I meet all the minimum requirements (above and beyond) and provided evidence of everything.

The application was approved, however the BRP letter on the second page says:
...
- (Non-Standard 1) - beacuse you satisfy the requirements of paragraph GEN.3.1. of Appendix FM; or
- (Non-Standard 2) - because you satisfy the requirements of paragraph GEN.3.2. of Appendix FM;

it means that you are currently on a 10 year route to settlement. If you continue to meet...
I don't understand why it says 10 years instead of 5 years? Is this right? I thought partners from international locations can only get a 5 year route in anyway?

Can anyone explain what GEN.3.1. or GEN.3.2. actually mean? I tried looking it up but it's not so clear.

Do you meet the Minimum Income Requirements of a salary of at least £18,600 per annum? Was it documented appropriately and over the required period of time?

As it seems that your spouse's visa has been issued under the Exceptional Circumstances section of Appendix FM, they have been put on the 10-year (FLR-FP) route rather than the 5 year FLR-M route.

That's what I thought as well. One learns something new everyday.

Exceptional circumstances of Appendix FM of the UK Immigration Rules.

Nevermind, I was mistaken.

It turns out there is another page on the BRP that comes before this that explains if your vignette says (STANDARD) then you are on the 5 year route and if you vignette says... and then it goes to the next page and talks about the (NON-STANDARD) stuff I mentioned above.

I had not seen / noticed the page before as it was double sided printed and took "this means you are on the 10 year route..." literally.

Her vignette says "(STANDARD)" so she is defo on the 5 year route, the letter is just explaining all the different types.
