ILR urgent help

Post by kash_m » Tue Aug 24, 2021 12:18 pm

Hi, URGENT HELP NEEDED
I am looking for some help with respect to variation of tier 2 extension visa into ILR application for my wife.
Details are as follows:
First visa date: 21 Sep 2016
UK Entry date: 30 Sep 2016
ILR due date minus 28 days: 24 August 2021
last Tier2 visa expiry date: 07 June 2021
Tier2 dependent application (first application): 4 June 2021 (still undecided)
ILR application -variation (2nd application): 24 Aug 2021

since ILR is due today on 24 August I have prepared application and arranged all supporting documents, I am ready to submit application but thinking if I should go for priority service (+£500) or super priority service (+£800), could you advise should I opt for super priority service and pay extra £800, would it increase chances of accepting my variation?

What I don't want to happen is that I receive decision on tier 2 extension before UKVI decide on ILR and end up paying extra £800 with no chances of refund of first application. Please advise what should I do go for ordinary service or priority or super priority service?

Priority service is NOT guaranteed at all. This has nothing to do with your variation as a new application will always be considered a variation of the previous one. We cannot tell if the scenario you are describing may happen or not. It is up to you to decide if you want to choose a priority service

Thank you Zimba, I have submitted application in standard service but taking biometric appointment tomorrow 25th August as I wanted UKVI to consider this varied application and not decide on previous tier2 extension application.

in case UKVI approves tier2 extension application and issues BRP after 24th Aug (date of variation of application) i.e. UKVI do not consider my variation of application, what options do I have? can I issue a complaint and request for refund of first application as I have fullfilled all requirements of variation.

When you apply for a new application the form asks you if you have a pending application with UKVI. If you choose to go with super-priority soon, you are very unlikely to get a decision on your previous case

oKay, thank you Zimba. Now that I have submitted varied application in standard service of 6months, should I just wait and see what response I receive from UKVI?

Can I request refund on previous application now? if not now when ?
Can I contact UKVI and inform them of variation of application so they do not decide on previous application?
is it possible to withdraw previous application now given a new application has been submitted?

thank you in advance for your help and support.

Refunds are done automatically. I suggest not to withdraw
