I can't figure out if I have Promise or Talent visa

Post by madire7799 » Sun Nov 07, 2021 7:18 pm

Hi all, my question is as silly as it says. I've been living in the UK for now over three years (since June 2018) and considering applying for my ILR. However, my ability to do so largely depends on which visa I have — I've reread my endorsement letter and it's not clear to me.

On my BRP, it says "Migrant Talent, Leave to Remain"

Upon rereading my endorsement letter, it says:

Thank you for your Application for Endorsement under Tier 1 (Exceptional Talent).
The application was forwarded to Tech Nation on [DATE] and they provided a
recommendation to the Home Office.
Tech Nation has advised that you meet their criteria for Exceptional Promise and I
am therefore satisfied that you can be endorsed under Tier 1 (Exceptional Talent).

I guess my questions are:
1. Does this mean I have Talent or Promise visa?
2. If I have the Promise visa, then does that mean I cannot apply until it's been 5 years? There's lots of conflicting information out there so I wanted to double check — thanks everyone!

Tier 1 Exceptional talent route does NOT exist anymore. Under that route, you would have been endorsed under “talent” or “promise” criteria. Tier 1 Exceptional talent is now replaced by the Global Talent visa and you must qualify for ILR under these new rules. So what is the eligibility requirement for a continuous period under the Global Talent visa?

Here is the snippet from the guide:
Eligibility requirement - Continuous period
The continuous period varies depending on a migrant’s specific circumstances. The
applicant must have spent a continuous period of:
• 3 years lawfully in the UK, if:
o they were granted their initial application using a prize listed in Appendix
Global Talent: Prestigious Prizes
o they were endorsed by The Royal Society, The Royal Academy of
Engineering or The British Academy criteria or UK Research and Innovation
(UKRI)
o they were endorsed under the exceptional talent criteria by Arts Council
England or Tech Nation
• 5 years lawfully in the UK, if they were endorsed under the exceptional promise
criteria by Arts Council England or Tech Nation

Applicants may combine time spent in the following categories towards the qualifying
period:
• Global Talent (including Tier 1 (Exceptional Talent))
• Tier 1 (General)
• Tier 1 (Entrepreneur)
• Tier 1 (Investor)
• Skilled worker (including Tier 2 (General))
• Tier 2 (Minister of religion)
• Tier 2 (Sportsperson)
• Innovator
