I don't think it's a new piece of information on top of what we already know.

If someone just decides to apply for an EP as an overstayed tourist for example, I don't think the same ruling can be applied.

The judgment basically says that the minister may or may not approve the application if the applicant does not have a permission, but either way the minister needs to provide sufficient reasons, which didn't happen in this case. It also said that the person could not be removed from the state as they still had a separate EUTR review application in progress.

That would just motivate the minister and INIS to provide a few more templates when rejecting applications, and get rid of any pending review applications beforehand (or just put them on hold until there is a decision on the review).

@littlerr : fair enough do you think that could be the reason minster puts all stamp 4 to stamp 1 EP application on hold.

Well I can't speak for INIS but it is indeed possible.
