ILR application advise on absences /process

Post by BGMBGK » Mon Dec 27, 2021 2:27 am

Dear Moderators ,
Thank you in advance

I am writing to ask advise on preparing for my ILR application.

Background - Health Care worker ( doctor), on Tier 2 VISA. Single Employer.
1st leave issued before Jan 2018
2nd leave issued in 2020.
eligible - 4 year 11 month now .
Cleared Life in UK
IELTS UKVI before coming to UK
query - 1) whilst to my understanding i believe i have not broken the continous residence
period. But there are times when i was out of the UK on paid annual leave for more than
30days ( except 8 days of authorized unpaid leave in 2020 to accommodate travel delays
and quarantine on arrival) .

I am entitled for 32- 37 days of annual leave /year( 37 working days in 2020 and 2021) all my annual leave I have always used to travel to my home country . These travel days ( out of UK) would include my annual leave + saturday /sunday /bank holidays in that period. Hence , if i avail a leave for 2 weeks starting from monday , i would travel the preceding saturday ( which was non working day ) and return after 2 weeks. The saturday/sundays in the annual leave period would not cost me any annual leave days.

so my query is when i right my absences letter ( take letter from my HR ) should that just mention my annual leave from and to....or should it also account the preceding non working saturday /sunday ?and in between saturday /sunday ?. As the number of days will vary ...an annual leave of 5 days /would typically mean 9 days of out of UK . I can assure I have not been more than 180 days either in consecutive /rolling
12 month period.

2) should I be writing a covering letter explaining reasons for absences spanning more than 30 days even if by nature of my job i have leaves ( 37days/year + compensatory leaves for working on bank holidays ) .If yes should i give evidence for my reasons .

In year 2020 - I had one long stretch of 45 days of authorised leaves ( 35 annual paid +10 authorised unpaid leave to accommodate travel delays and quarantine on arrival , it was all sanctioned even before i travelled).( including saturday /Sunday /bankholidays during these 45 days would be 61days, which was the number of days i was out of UK ). I am aware that 4 weeks of authorised unpaid leave /calendar year before COVID was and is permitted. In my situation it was peak COVID 1st WAVE, and it was all authorized.
SHOULD I WORRY ?

from year 2021- - had 2 periods of leave spanning 30 plus couple of days , but all authorized and paid.
SHOULD I BE WORRIED.

do we physically upload IELTS test result or just the UKVI number is enough?.

Life in UK did not give me a certifcate....is it again some reference number to be quoted?

what is the processing time from application to receiving BRP , if i opt for 5 day service. Can i know the chronology of steps, Is it Application /approval/biometrics /receive BRP? or something else.

I apologize for a long write up.
I am sure i will be benefitted by the responses.
kind regards

Read: indefinite-leave-to-remain/tier-2-set-o ... l#p2027888
All digital evidence is accepted.

Application /approval/biometrics /receive BRP is correct. BRP may arrive much later after the approval

There is no specific evidence. The link I posted made this clear. Just an employer letter that stays all the absences from work was authorised by them is enough
