I came to the UK in 2008 on one year student visa. it was renewed in November 2009. when I applied for another renewal in November 2010; the visa was refused on the basis that the Home Office was unable to collect the fees due to Barclays Bank closing my Bank account on the very same day the money was supposed to be collected. I sent them a letter to let them know this but they never replied and in the end they returned my application with the mention that I should leave the country as I was now an over stayer.
I spoke to a solicitor who advised I should send them a protocol for judicial review, which I did and in February 2011, the Home Office sent me a letter asking me not to leave the Country until I hear back from them.

In April 2012, I claimed asylum on the basis of change of circumstances and the asylum was declined in May 2012, then I submitted an appeal which was granted on 13/08/2012.
In October 2014 I got married to a British Citizen, we now have two children who are both British citizens.
In 2018 I was granted ILR. As I was preparing to apply for citizenship, I got 6 points on my driving licence on 21st February 2019 due to a friend speeding with my car but He provided the wrong details to the Police while I was out of the UK. By the time I came back; the fine was already at the court and there was no way I could challenge it. The fine expires on 21st February 2022.

My question is: How soon can I apply for citizenship on the basis of Five years residency or even on the basis of spouse of a BC?
would my over staying situation ten or eleven years ago have a impact on my application.

On or after the 10th anniversary of the grant of leave following this application.
