My ILR application is still under processing (for 5 months) but my wife's and kid's BRP are expiring on 30/01/2022.
In order to make an in-time application, I am preparing to apply for my wife's Spouse visa while my ILR decision is still pending. I am thiking of writing a cover letter askin UKVI to put their applications on hold until my ILR is granted.
My question is on the English language requirement for Spouse visa.
She previously provided her IELTS results in 2019 for a successful Tier 4 application. I have read the document "English language requirement: family members under Part 8, Appendix FM and Appendix Armed Forces - Version 8.0". It says -
"A partner or parent applying for leave to enter or leave to remain is not required to provide evidence of meeting the English language requirement if they have done so as part of a successful previous application in any category. Paragraph 32D of Appendix FM-SE provides for when this earlier test certificate or result can and cannot be used."
When I referred to 32D in Appendix FM-SE, it says -
"32D. If an applicant applying for limited leave to enter or remain under Part 8 or Appendix FM submits an English language test certificate or result and the Home Office has already accepted it as part of a successful previous partner or parent application (but not where the application was refused, even if on grounds other than the English language requirement), the decision-maker will accept that certificate or result as valid if it is:......"
The first document says in any category while Appendix FM-SE 32D says partner or parent application. So can she use her 2019 IELTS result submitted for her Tier 4 application to satisfy the English language requiremnet for her Spouse visa application?
