non-EEA family member of dual EEA/UK national

Post by szy123 » Mon Feb 21, 2022 10:14 am

Hello All

I'm a dual EEA/UK national. I was born in Poland but have been living in UK since 2002. Got my UK citizenship in 2010. Married my wife, who's from Philippines, in 2011. We got married under EEA rules in UK. She got her 5 year EU spouse visa, then BPR in 2016 and then EU settled status (referred to as Indefinite Leave) in 2019. We've just recently submitted her online application for naturalisation. Her UKVCAS appointment is in 2 days.
I have 3 questions:
1. do we submit supporting documents required claiming she's a spouse of British citizen (last 3 years) or EEA citizen (last 5 years), since I have both?
2. There is a 3 page consent form to sign. 1st page for her, 2nd page for me because we have joint mortgage and 3rd page is for a sponsor. Am I a sponsor if my wife doesn't work. She's been a housewife for last 5 years looking after our boys and I'm the only provider.
2. On UKCEN forum I've read about something called 'Lounes application'. It said that if you're a non-EEA family member of dual EEA/UK national you should apply using 40-pages long form, rather than online, as this situation is much more complex. It also says that I, as her sponsor, should provide my P60 for last 5 years, both passports, etc. Is this really the case in our situation? Should we have applied using paper form?

I would really appreciate if you could help us with the matter above.

Thank you

You only need to do one - most people would do the 3 year path.
2. There is a 3 page consent form to sign. 1st page for her, 2nd page for me because we have joint mortgage and 3rd page is for a sponsor. Am I a sponsor if my wife doesn't work. She's been a housewife for last 5 years looking after our boys and I'm the only provider.
This is a recently introduced requirement and not totally sure that parts 2 and 3 apply to naturalisation as there are no financial requirements for naturalisation and applicants are not sponsored. Suggest take it to the appointment - they should tell you what exactly needs signing. Note this relates to data protection rather than statutory nationality requirements.
2. On UKCEN forum I've read about something called 'Lounes application'. "Lounes" has nothing to do with naturalisation! Note that you are not sponsoring your wife for naturalisation - the individual applicant has to qualify for the requirements.

I would really appreciate if you could help us with the matter above.

Thank you
