ILR - Insufficient documents, sent back from PEO Croydon

Post by Will_I_Get_ILR » Sun Nov 02, 2008 10:04 pm

Summary of my immigration status:

- Came to UK in Nov 03 on Work permit
- Continued working on the WP (3 extensions) until April 07
- Got HSMP in May 07
- Was on unpaid leave in June 07 (no salary in June 07 bank statement)
- Worked outside UK for the same company between July07-Sep07 (salary paid in India)
- Changed jobs in Sep07 and have been continuosly working in UK since then (have got all salary slips and bank statements to prove that)

In a nutshell I cannot provide bank statements between June07-Sep07 to reflect my income in UK but have letters from my employer and the client confirming that I was employed and also that I was required to travel outside UK. I can substantiate the same by showing payslips & bank statements of non-UK account (salary was paid in India by my employer).

I had requested for some info on this forum few days back and was advised to produce last 12 months pay slip for my application - which I duly provided during my appointment in PEO Croydon last week.

However, I was asked to provide pay slips & bank statement from the time I got HSMP and was also told that if I cannot prove income for few months then it would be considered as a break in employment and I would not be eligible for ILR.

Any advice on the above situation would be highly appreciated.

Thanks

In my opinion there are two options,

a) You either take another appointment at PEO and hope that this time around they consider your application. It is pretty wierd, but there are instances where PEO have behaved inconsistently, and hence there could be a slim chance that you may get through.
b) Have a chat with someone from UKBA and explain them your situation, and/or assess the possibility of applying by post.

Thanks for this. Could you or someone else who has applied for ILR in HSMP category (and was previously on WP) can confirm if he was asked for all his bank statements and salary slips for the duration he/she held the HSMP?

Thanks
