Confusion choosing Visa category for ILR

Post by Arisha1988 » Fri Feb 25, 2022 6:19 pm

Hi experts!
I am applying for my ILR and want to check if i need to use SET(M) or SET(O).

Background facts: My husband completed his 5 years under tier 2 general visa category in april 2021 and at that point i completed as his wife 4 years as PBS dependant. As my husband’s tier 2 visa was expiring in April 2021 so he submitted his application for ILR. We then separately submitted to extend my PBS depedant visa under”PBS, Start-up, Innovator or Global Talent dependent partner” caregory.

I got approval for my application stating “dependant of xx on the skilled worker route” has been succesful. However, My new Residence permit says “DEPENDANT Partner” whereas previous residence permit said “PBS Dependant”.

Question: can i proceed submitting my ILR application under SET(O) because in the approval email i got it clearly states my visa was extended as a dependant of skilled worker route. However, what causes the confusion is they state on Residence Permit “Dependant Partner”, is this a change of terminology on Residence permit and my visa category is still the same.

Thanks alot for your prompt response. Do you think this is change of terminology on residence permit and therefore no change in my visa Category?
