Hi;

got a question regarding para 317 HC 395 on persons being granted leave to enter or remain in the UK as parents/grandparents of a person present and settled in the UK. As the para states the parent must be widowed and over the age of 65 or both travelling together, of one who is over the age of 65.

My question is where the parents are seperated or divorced and over the age of 65 what will happen. From what i was told the rules for parets under the age of 65 will apply. Can someone confirm and know of any relavant case law with regards to this.
