BRP Requirement As a BNO

Post by faat99 » Mon Mar 07, 2022 12:58 pm

Hi All, I require to travel urgently, and appreciate your insights. Apologies in advance:

Quick background: I have ILR + BRP, I currently reported BRP lost and in process of replacement. I note that this will take 6 months. I now plan to travel to Germany for work, I fear that I will be refused entry given my lack of BRP. I have few options below as I am aware, I'd greatly appreciate if you can shed some lights whether these are plausible route?

1. I am from Hong Kong with British National Overseas (BNO) passport, hence can travel to UK without visa for holiday, etc.
2. BRP replacement visa overseas - how long would this take generally?
3. Is there any way to accelerate the existing BRP replacement process? I note that there is a fast track service, but does that fast track the existing process or just open a new application?

Thanks again..

If you are a non-visa national then you get on a plane, arrive at the border explain the situation and get in as a resident without the need for a BRP

Zimba, may I pick your brain further, in an unlikely scenario I was refused at the Border, due to my lack of BRP, will that has any detrimental effect in future if I apply for converting my ILR to British Citizenship?

Thanks.

Do you have an official reference for this?

Base on my researches past days, there is not an official procedure. However there are known amount of cases of successful entry, it is purely on the Border Control's discretion. There is a risk you will be refused.

Most success cases were wallet being stolen, in my view I feel my case will actually be riskier as I am knowingly travel outside UK while waiting for the BRP.

British Nationals (Overseas) are British nationals but not British citizens, and they are not considered 'foreign aliens' under UK law. BN(O) citizens do not need to apply for residence permits if they remain in the United Kingdom for up to 6 months. But because of the recent events in Hong Kong, all such citizens can now come and apply to stay here under the British National (Overseas) visa and then get ILR.

In your case, you already have the ILR status and the border staff can easily verify this on their systems. The risk of being refused entry for you is ZERO
