Certificate of entitlement to right of abode passport stamped with entry conditions

Post by Jswhu19 » Mon Mar 21, 2022 8:26 pm

Hi there,

I have a foreign passport with a certificate of entitlement to the right of abode in it.

Normally when entering the UK border, the officer won't stamp my passport. There was one occasion where an officer stamped it with the date/time and the UKBA said it was a mistake but not a big issue to cause concern.

However, today an officer had stamped it. I tried to prevent it from happening but they stamped it anyway. I thought it was not a big issue if it was just a date/time stamp.

When I got home, I was quite shocked to see " leave to enter for six months- employment and recourse to public funds prohibited" stamped. I assumed it was just a date/time stamp so didn't raise it further while there.

Obviously this is a mistake because as a ROA holder, I can stay for more than six months and obviously I've been working here for the last few years.

What should I do in this situation? Is it a concern that they stamped this? I've already sent an email to ukba but this will take 20 days. I am due to travel again next week so not sure if this will cause issues when I get back.

Any advice appreciated.

Thanks.

I suspect that date stamps are okay as they may just record entry dates. But they are highly unusual for people with a CoE-RoA or British citizen passports, unless there was a policy change. Visitors’ conditions may appear if they pressed too hard or incorrectly when stamping.

Moreover, conditions cannot be imposed on people with a Right of Abode.

If they had rejected that you had a right of abode, then I think they would have revoked or cancelled your CoE-RoA instead of incorrectly imposing conditions without any explanations.

If there has been no changes in policy, as the UKBA had confirmed to you, then I suspect that these two Immigration Officers were insufficiently trained and the second immigration officer was following an incorrect example of the first immigration officer.
