I am 33 years old and my wife is 30 years old we are both University graduates. I have a number of internationally recognized IT certifications too so do my wife but she is not working at present as she is taking care of the children.



We both have two daughters together, the older daughter of the two children is 5 years old and the younger one is 14months old.

Our older daughter was born in our home country Nigeria and we came over to the UK as Working Holiday Makers fours ago. She is in her first year of her elementary/primary school education here in the UK and doing very well academically.



The second child was born here in the UK about 14months ago and my wife is presently pregnant with our third child.

I tried converting to HSMP towards the end of our WHM visa which I was sure I was qualified for conveniently but the case worker who decided our case just refused to grant us the application and by the time the reply came, our leave to remain had expired.

I have since continued working in my profession as an IT consultant running my own company which is duly registered though for contract purposes. I pay all my company taxes, VAT and personal taxes as at when due with all the records available having been assigned a legit NI while on WHM status.


We are yet to buy a house of our own but we have a few plots of freehold lands across UK in our names as landed properties for which title deeds are available.

However, what am looking for is an opportunity to regularize our stay in the UK without having to leave the country at all during the application or prior to that which is what i hope you will be able to help me achieve.

You have little hope of resolving the situation. You and your family are overstayers so are liable for removal at any point. Nothing you have stated will change the position.

Why were you refused your HSMP? That will give any idea as to how the forum might be able to help you.

There is very little possibility of regularising your stay in the UK. You should seek legal advice asap, as you could be liable for removal/deportation at any moment (i.e. during a raid, if they check on your company, etc). Although you have some ties to the UK, since neither you, your wife, or children are British/EU citizens, there is little ground for an in-country application (i.e. your wife is expecting so you cannot travel at the moment, etc).

You should look at either returning to Nigeria and applying for Tier 1 (with professional advice), or, if that fails, moving to another country, such as Ireland, or even the US, Canada, etc, as a skilled worker.

Unfortunately, those are the only choices you have.
