Query regarding Workpermit (Band 5 to Band 6 change)

Hi all,

My wife is working for NHS trust as a band 5 grade staff nurse (Critical care nurse). She has completed 4 years in UK in August 08. Her current leave is valid until July 2011. she got her initial leave valid until June 2010 but due to change in her employer her leave is now valid until July 2011. New Point Base System will be implemented from 27th November 08. My wife was told by her Matron that there will be vacancies for Band 6 post and she can consider her for the band 6 post in January 2009.

So for to change the band from 5 to 6 my wife's employer needs to apply for the fresh work permit or she do not need work permit as she is working for the same employer and in the same critical care unit.

Is new Point Based System affect this as this will be going to happen in January 2009 after the implementation of new Point Based System.

Any information regarding this is highly appreciated.

i am a critical care nurse also and i was told that my current work permit is valid for any position within the trust.

i don't see any reason why she would need to apply for a new work permit. the problem comes up if you need to renew your work permit because it is due to expire, but it sounds like your wife has plenty of time.

also, keep in mind that critical care nurses are still on the shortage list so technically she would be able to take a position in another trust as long as it is in "critical care". however in practice, most HR's seem to be reluctant to want to go anywhere a work permit right now.
