appeal refusal of eea pr

hi
does anyone have experience of appealing pr refusal, my bro has just been refused and given 5 days to appeal. which he intends to do. how long does this process take.
and what is required of my bro.

he submitted his app. for pr on nov 07, on grounds of separation, the wife had only left a few months before pr was due. so he applied with an explanatory letter and anything he could get with his wife's name . the ho asked for more evidence in may and he sent her english course certificate.
he just got a letter this morning saying he has been refused bcos his wife eu id card the he gave them has expired. they totally disregarded the letter that was sent to them about the marraige situation. he has been given 5 days to appeal. his lawyer would appeal and also ask for a reconsideration. what do you think, should he start a divorce now? how long before his appeal gets to court.
