Confusion over new BRC

Post by pamzee85 » Fri Apr 29, 2022 9:48 pm

Please help as I’m quite confused. All my fault ofcourse. Here’s the timeline
20/2/22 applied for settled status using the EUSS settlement scheme.
9/4/22 applied for new BRC under my pre settled status as hadn’t received word on my settled status application and needed to travel and my BRC expired 22/3/22
19/4/22 received notice to attend biometric appointment
26/4/22 received HO email advising I’ve been granted ILR or Settled Status and letter says that if BRC is no longer valid then new BRC will be sent in 10 working days.
Obviously my application for a new BRC under my old pre settled status will no longer be valid hence I haven’t booked the biometric appointment. So do I just hang tight and wait for new BRC issued under my new status or do I book a new appointment as current biometric appointment was made on my pre settled status

I believe...

That if you applied for Settled status using the app (and your old BRC) then you won't receive a new BRC. The system is designed to only issue new BRCs to people who don't have one.

Since you had a valid BRC at the time of application, the system records this as that it doesn't need to issue you a new BRC. Yes, your BRC is now expired and you need a new one, but the Settled Status application doesn't know this. It should, but I think it doesn't. I believe you are not the first person in this situation that has been left waiting for a BRC that never comes.

I do not know if your old application for your BRC under your pre-settled status is invalid. Maybe it isn't. But the fool proof way of making sure you receive a BRC that reflects your current status would be to cancel your old BRC application, and submit a new BRC application under your new Settled Status and attend the corresponding biometrics appointment.

Bottom line is: believe that doing nothing will not bring you a BRC as, as I said, a BRC is NOT automatically issued when you get settled status by using the app. You need to apply for it.
My posts express what I believe are the facts, based on the best of my knowledge, about the topics discussed in this forum. They do not constitute immigration advice.
