Spouse visa question

Post by Olay90 » Thu Feb 17, 2022 10:06 am

Hi,

I'm new to the forum :) I just want to clarify a few things please:

My husband is in the process of applying for a uk spouse visa with me being the sponsor. I'm currently working in the uk and will be applying under Cat A, non-salaried employment as I get paid by the hour. However I have a few questions:

1) I have two payslips in december (as opposed to one - i get paid monthly). This is because my employee number changed in december. So for the month of dec, i have two payslips with different employee numbers, although every other detail remains the same. Can I still use the two payslips coz if I add up the incomes, they meet the threshold for the month?
Please note that the payslips are from the same employer.

2) My bank statements are still in my maiden name. Can I use them as they are so long as my marriage certificate is also in the documents?

Thank you all for your response 🙂

Thanks very much AmazonianX. I have one more question - may sound silly but on one of my payslips, the gross pay is less than the net pay ( due to a tax refund). Is there any chance that the Home office will use the higher amount even though it is the net pay?

Thanks.

Gross pay is what the Home Office takes note of and can only hope its clear enough to them....is the narration of tax refund also printed on this payslip?
You may want to explain or call attention to this in cover note.

Hello again AmazonianX,

Thanks for all your help so far and I can't help worrying over the financial requirement and employment letter. I have been reading previous threads and I'm still getting confused about this topic. I am of the opinion that I am non-salaried based on my varying monthly income but I just want to be 100% sure to avoid any issues. Please pardon the long post so here goes:

We're hoping to apply in May and I have been employed with my current employer since Oct 2021 and I am paid hourly based on the hours worked. My employment contract says that my standard working hours are 36hours per week at a rate of 9.30 per hour (this hourly rate was increased to 9.62 in Jan) and that normal hours of work are various as per roster and that I may be required to work additional hours as necessitated by the needs of the business. I have been working in excess of my contracted hours so as to meet up the financial requirement as ordinarily I wouldn't meet the threshold based on my contracted hours only. I get paid on the 7th of every month. So I believe this makes me non-salaried?

The following are my pays for the 6 months from Dec to May:
7 Dec 2021 - 1575 @ 9.30 per hour
7 Jan 2022 - 1309 @9.62 per hour
7 Feb 2022 - 1606 @9.62
7 Mar 2022 - 1621 @9.62
7 April 2022 - 1962 @9.62 (I already know this will be my pay based on the hours for the month, all things being equal)
7 May 2022 - 1400 (based on my contracted hours but may be higher if i do more)

So based on the above, a total of 9473, therefore an annual gross salary of 18946. That is correct right?

Also, in my employer letter, does my employer need to mention the pay rise based on the question "how long has the applicant been earning employment income relied upon" or does that only apply to salaried employment? Again, will my employer need to calculate my annual income based on my contracted hours or based on the calculation above? I'm just concerned that if my employer calculates my gross income based on my 36 hours, the financial requirement will not be met. Or how will the letter be worded to show that i'm non-salaried?

I'm a nervous wreck over thinking this.

Thank you so much for your anticipated response

Payslips query

Post by Olay90 » Sat May 07, 2022 3:59 pm

Hi,

I would really appreciate some input regarding my payslips as I have been worrying myself over this. We're planning to apply for my husband's visa before the end of the month so we're currently putting together all documentation.

I have been with my current employer since 5th Oct 2021 and I get paid hourly. The payslips are dated 7th of every month for work undertaken the previous month and money is deposited into the bank on the same day. So am I right to include the following payslips? Dec 7, Jan 7, feb 7, mar 7, apr 7 and may 7
Do they all cover the whole 6 months? I'm just worried because I read somewhere that 7 payslips need to be included.

Any help in this regard will be greatly appreciated. Thank you

The listed 6 payslips sufficient so far the last one is within 28days of submission/not older than 28days from submitting.

Your payslips above fulfils the requirement.

You only 6 months payslips showing all your income has been paid and it matches your bank statements. You would only need 7 payslips if you are paid 4 weekly and this does not apply to your situation.
My opinions should not be constituted as an immigration or legal advice.
