Spouse Visa Renewal due Sep-22 - cash savings query

Post by CALLUMRF23 » Tue Jun 07, 2022 11:15 am

Hi all,

Firstly, apologies if this has already been touched upon. I have searched the board but cannot find anything, so please direct me to where it is if there is already an answer...

My wife's spouse visa is due for renewal in September this year. I myself have recently gone self-employed (May 2022) and sold a property in February 2022 which has left me with cash savings above the required £62,500 limit of a spouse visa renewal. It is these cash savings that we will be using as proof of funds for my wife's visa renewal, along with supporting documentation.

We have read the gov.uk website regarding the requirements but can't seem to clear up if we are able to apply now (June 2022) based on the cash savings (that we've had for 4-months so far)? The gov.uk site says you can apply at any time to extend but cash savings funds must be held for a minimum of 6-months. They also say that if a property has been sold within that period and you are using these funds as proof, you can apply so long as the the relevant documentation is provided (I have read it as the property must of been an investment property overseas - ours was in the UK). Additionally, I have read elsewhere online via immigration lawyer websites that the earliest you should apply for renewal is 28-days before expiry. Can someone kindly clear this up for me before we apply?

Thank you so much,

Callum

Your wife can apply now if she wishes but as the new visa will be for 30 months this may mean that a further permission will be needed before she will be eligible to apply for ILR. This is the drawback of applying too early.

Subject to the conditions set out on p49/50 of the guidance
https://assets.publishing.service.gov.u ... rement.pdf
she may use the cash savings you have even if they have not been held for the full 6 months prior to the date of the application provided they are the proceeds of the sale of a property which you owned at the beginning of the 6 month period.

Thank you for the information, it is very handy.

The Government gave my wife an initial 33 month spouse visa (Dec 2019-Sep 2022), so whether we apply now or in a couple of months, we will be well within the timeframe for her overall visa length.

Thanks again,
Callum

Yeah, the first 3 months is to allow you pack your bags and get ready to move to the UK. Not everyone can drop everything at once and relocate. Regardless, it starts to count from the minute she crosses the boarder. It becomes activated.
No sin in failing, you just have to try and try again!

Thanks for that additional info. She crossed the border a few days after issue/approval, so already has 30-months of use.

Cheers,
Callum
