Hi Zimba, we are in the same situation as the original poster of this thread. How should we go about this question:

Have you spent any of your two, three or five year continuous period (as appropriate) with leave to enter or remain in the Crown Dependencies?

Should my wife answer yes to this? If yes, this will ask the type of visa/permit my wife had when she stayed at Channel Islands. Or should we just answer no to this?

Hi Zimba,

Apologies. I have replied on your comment to uk2213 as we are on the same situation as them.

My wife has a working visa for Jersey before in 2016 and then switched to a PBS dependent visa to join me in the UK in July 2017. She didn’t move to UK immediately when the visa was issued. She only moved late December of that year but has been in and out the UK before moving permanently. Following the qualifying period, we believe she is already qualified to apply for ILR in July 2022.

While going through the form, there is a question:
“Have you spent any of your two, three or five year continuous period (as appropriate) with leave to enter or remain in the Crown Dependencies?”

Do we have to answer yes to this considering she was in Jersey in July 2017 and only moved in December?

We tried answering yes and it has asked what type of visa/permit she has in Jersey.

We were thinking to provide a cover letter to explain she’s been in and out in the UK from July 2017 although we cannot provide any evidence of that as she hasn’t kept copy of flight bookings and there is no stamp available as the immigration don’t do that if it’s between Jersey and UK. Do you think this would be acceptable?

The permit will be the UK PBS dependent visa. That question is not important at all

Because it has no effect on the ILR. There is nothing that changes the ILR eligibility
