Hi Moderator,

Can I please check if you have to satisfy three year (6(2) or 5 year 6(1) residency requirement if you wapply straight after getting ILR (as spouse has British passport)?

ILR route: 5 year TIER 2 DEPENDENT granted in September 2022
HUSBAND: BRITISH CITIZEN
QUESTION: DO I NEED TO SATISFY 450 days in 5 years or 270 days in 3 years? I was not in the country 3 years before I am planning to submit my application so would appreciate the conditions applied

As a spouse of British citizen you need less than 270 days in 3 years and you need to have been physically in the UK and not travelling on the day 3 years + 1 day prior to your application (eg if you want to apply on the 1 November 2022 you need to have been present in the UK on the 2 November 2019).
