Overstayer Family route application

Post by sha66ir » Fri Oct 21, 2022 9:12 pm

Hello

A little background about me. I will try to keep it simple.

I am an overstayer. I met my now wife while I overstayed my visa.
After the birth of our child we applied for family route on the 21st September 2022.

I have my litigation debt paid, no criminal conviction.

Today I received an email from the HO as follows:

"Thank you for your application for permission to stay in the UK.
We apologise for the inconvenience, but due to further checks needed on your case we are not able to meet our usual service standards.
Although we would normally decide your application within eight weeks from the date it was submitted, unfortunately this may not be possible in your case.
If your application was submitted prior to your current grant of leave expiring, your current status within the United Kingdom has been extended by section 3C of the Immigration Act 1971. You do not need to do anything else at this stage and do not need to be concerned about your immigration status.
If you have applied to switch your status in respect of your employment or studies then please refer to the guidance on Gov.UK as you should be permitted to commence work / study prior to your application being decided, should you meet the conditions set out in the guidance.
We apologise for the delay in dealing with your application and for the inconvenience this is causing. Please be assured we will do all we can to make a decision on your case as quickly as possible.
We appreciate your patience at this time.
Yours sincerely

HOME OFFICE"

Can anyone translate this to me. What other check do they need to do?

Thanks

We don't know. Home Office does.
It's a generic email, most likely, as it's been exactly a month since your application; they might've asked some other departments to provide them with information about you.
You just need to wait I reckon.
Not a qualified immigration adviser. Use links and references given to gain confirmation and/or extra information.

Being an overstayer, you should have expected that your visa application wouldn't go as smooth as expected.
Your current situation has triggered the auto-response. This basically says, you're not getting it in a hurry. We might be needing more details from you on a later date.
No sin in failing, you just have to try and try again!
