Child Born outside UK ILR application

Post by HANAFY4 » Wed Nov 02, 2022 4:02 pm

Hello everybody,

I have got my ILR based on tier 2 general visa path. My wife got her ILR as defendant on my visa.
I have child born out of UK.

I want to apply for his ILR, as both of the parents got the ILR, my questions are:

1) Can my child apply for ILR ?
2) Is that link is the accurate one to apply for my child?
https://visas-immigration.service.gov.uk/product/set-o

3) I used that link and draft make the application, however, in the documents, we have not been asked any approve of the parents ILR, even in the application I did not see any questions about the parents ILR data. IS that normal, or am I using the wrong application link ?

I am looking for your help, please.

Kind Regards

https://visas-immigration.service.gov.uk/product/set-o It should be the same link and you used for your spouse

IS that normal, or am I using the wrong application link ? Make sure you add a copy of you and your spouse ILR.

I am looking for your help, please.

Thank you for your reply.

regarding point 2, do you mean I mentioned is correct, as I do not remember the link I have used in my wife application ?

Regarding point3, is that normal that they do not ask for the ILR information of both parents and not asking in the mandatory or optional data about copy of them ?

I fully agree with you that I need to include copy of them, this is why I am asking.

Kind Regards

regarding point 2, do you mean I mentioned is correct, as I do not remember the link I have used in my wife application ? Yes that's the link.

Regarding point3, is that normal that they do not ask for the ILR information of both parents and not asking in the mandatory or optional data about copy of them ? Every case is different. Every form is filled differently as well. Most importantly, the system isn't perfect.

I fully agree with you that I need to include copy of them, this is why I am asking. Correct train of thought.

Kind Regards

Both SET(O) or SET(F) forms can be used for child settlement. You do not need to tell UKVI that you have ILR. UKVI has your immigration files :?
Advice is given based on my personal research and experience only. Do NOT contact me via private message for immigration advice

Thank you so much for your reply dear Zimba and dear Ticktak.

The documents requested at the end of my child application as follows:
1) - passport
2) - Consent for for the home office
3) - Evidence of immigration status
4) - declaration of myself as parent to confirm the consent for the home office for verification checks
5) - the BRP of the child
6) - All previous passports and travel documents or national cards used to travel to UK

As you can see no ILR requested from the parents. I am not sure if that is normal, as in my wife ILR application, she has been asked the ILR of myself, as he main applicant. I am not sure, if I did correct application for my child.

Regarding point 3, what Evidence of immigration status is? can I use BRP for that?
Regarding point 5, he do not have any old passports or cards, he has only one passport, so what shall we submit for this point?

Another question, what the difference of using set(o) than using set(F)? Note: my child was on dependent visa of my tier2 general visa for 5 years, and both parents got the ILR? Which set shall I ?

I found in this link https://www.gov.uk/indefinite-leave-to-remain
Then, I select If you have family in the UK (if you have a partner, parent or child or other relative settled in the UK - either as a British citizen or a person with indefinite leave to remain.)

Then, I have selected a child - as a dependant on your parent’s work visa
Then, I applied for my child from that page.

Is that correct ?!

I want to confirm that and be sure is correct, before I submit the application and do the payment.

Looking for your valuable support, please.

Kind Regards
