ILR to BC : 12 months or no wait?

Post by avaismohammad » Fri Dec 23, 2022 11:07 am

Hi There,
Wondering if someone can help me on this confusion please. Lots of articles and discussion but cannot be so sure of it.

Dependant's Entry & Status : Jan 2019 PBS Dependant
Main applicant's status : Jan 2019, Tier 2 Gen

Main applicant's status : Nov 2019, ILR Granted

Dependant's Status : Dec 2020 extended PBS Dependant (on basis of main applicant's Tier 2 Gen even though MA had ILR)

Main applicant's status : July 2021, British Citizenship and passport Granted.

Dependant's Status : Dec 2023, ILR due..

Can dependant apply for British Citizenship/Naturalisation right after ILR in Dec 2023 or wait for 12 months is required?

Thanks

Thanks
No sin in failing, you just have to try and try again!

The answer isn't really that complicated and hasn't changed for years:
as soon as spouse gains ILR she can apply for naturalisation based on being spouse of British citizen (Section 6(2)) - no wait time, if she satisfies all requirements. Please look through the guidance, if not done already: https://www.gov.uk/government/publicati ... n-guidance
Note for naturalisation there's no distinction between main or dependent applicants.

I guess I got confused when articles said Spouse Visa etc. I believe Spouse visa is different to Dependant visa (even if it is for wife). So for PBS Dependant visa type we can apply for BC straight after ILR acquisition. Thank you so much :)

Generally, what counts for naturalisation is ILR - you must have it - the route to it is not relevant.
