NATURALISATION WHILST IN AN IVA

Post by icebrick » Fri Nov 28, 2008 12:33 am

Hi all
I got my PR at the beginning of this year and entered into an IVA just a few months ago. My Ex left me broke but that's a not relevant.
I wish to apply for Naturalisation in a few months time as soon as I complete the first year from the date of receiving my PR. Can the Home Office decline my application on the grounds of me being in an IVA? I heard that Bankruptcy is something they are well opposed to but an IVA cannot surely be that bad.
Cheers.

Hi,

You probably mean naturalisation, which is the process to obtain British Citizenship. It has a requirement of the applicant being "of good character". Others would be able to tell you how the IVA reflects on your character.

So is that saying that a person with an IVA may not be regarded as one with good character? Please be honest as I take no offence.

There's nothing explicitely stated about IVAs but it does mention insolvency to be an issue. Any thoughts?

It does mention that there shouldn't be a problem if the repayment arrangements are acceptable.

Are all your creditors happy with the IVA?
